• EPCO reserves the right to update, change or amend this Cookie Policy from time to time. Such update, change or amendment will be communicated via the Website. If you do not accept the updates, changes or amendments, you must inform us by sending an e-mail to info@epco.be. If we do not receive an e-mail from you within three (3) business days after we have announced the changes to our Cookie Policy on our Website, you will be deemed to have unambiguously accepted all such changes.

3 PURPOSES OF EPCO'S USE OF YOUR PERSONAL DATA

• EPCO processes your personal data for statistical analysis purposes so that we can improve our Website, products and services or develop new products and services.
• EPCO processes your personal data in order to inform any third party in the event of a possible merger, sale or an acquisition or demerger, even if that third party is located outside the EU.
• EPCO may also process your personal data in order to protect its legitimate interests and those of its affiliates, partners or a third party when your use of the Website may be considered (a) a violation of this Cookies Policy or the intellectual property rights or other rights of a third party, (b) a threat to the security or integrity of our Website or any of the underlying systems of EPCO or its affiliates or subcontractors due to viruses, Trojan horses, spyware, malware or any other form of malicious code, or (c) hateful, obscene, discriminatory, racist, defamatory, contemptuous, offensive or in any other inappropriate or illegal manner.

4 LEGAL BASIS FOR THE PROCESSING OF YOUR PERSONAL DATA

5 THE RECIPIENTS OF YOUR DATA

• EPCO does not send your personal data in a directly identifiable manner to a third party without your explicit permission. 6 QUALITY ASSURANCE

• EPCO shall process only those personal data which are necessary for the purposes listed in Article 3.
• Your personal data will only be processed for the time necessary to achieve the purposes listed above or until you withdraw your consent. It should be noted that withdrawing your consent to their processing may mean that you may no longer be able to use all or part of the Website. EPCO will depersonalise your personal data when they are no longer necessary for the purposes set out in Article 3, unless there is:
  1. a prevailing interest for EPCO or any other third party to keep your personal data identifiable;
  2. a legal or regulatory obligation or a judicial or administrative order preventing EPCO from depersonalizing them.

Only EPCO or its subcontractors' personnel who need to know your confidential data will have access to it and they will be subject to strict confidentiality obligations. However, you understand that safety and security are best efforts obligations only.

7 YOUR RIGHTS

• You have the right to request access to all personal data processed by EPCO concerning you. EPCO reserves the right to charge administrative fees for several subsequent access requests that are clearly submitted in order to harm or cause nuisance to EPCO. In such event EPCO may also choose to refuse these subsequent requests.
• You have the right to request the rectification of any personal data concerning you that are inaccurate free of charge. In the event of a request for rectification, this request must be accompanied by proof of the erroneous nature of the data for which rectification is asked.
• You have the right to withdraw your earlier given consent for the processing of your personal data.
• You have the right to request the deletion of personal data concerning you if they are no longer necessary for the purposes set out above or if you withdraw your consent to their processing. However, you should keep in mind that EPCO will assess your deletion request against:
  1. the overriding interests of EPCO or any other third party;
  2. any legal or regulatory obligations or judicial or administrative orders that may conflict with such deletion.

Instead of requesting the deletion of your personal data, you may also request that EPCO limits their processing if and when (a) you dispute the accuracy of the data, (b) the processing is unlawful or (c) the data are no longer necessary for the purposes listed in Article 3 but you need them to defend yourself in legal proceedings.

• For the purposes mentioned in Article 3, you have the right to receive from us, in a structured, commonly used and machine-readable format, all personal data you have provided to us.
• Where we rely on our legitimate interests you have the right to object to the processing of personal data if you can prove that there are serious and well-founded reasons linked to particular circumstances guaranteeing such opposition. However, if the processing operation envisaged is a direct marketing operation, you have the right to object to such processing free of charge and without justification.
• If you wish to submit a request to exercise one or more of the rights listed above, you may send an e-mail to info@epco.be An e-mail requesting the exercise of a right shall not be construed as consent to the processing of your personal data beyond what is required for the processing of your request. This request must clearly indicate which right you wish to exercise and the reasons for the request. It must also be dated, signed and accompanied by a scanned copy of your valid identity card proving your identity.
• EPCO will inform you promptly of the receipt of this request. If the request is valid, EPCO will honour it as soon as reasonably possible and no later than thirty (30) days after receiving the request.
• If you have any complaints about EPCO's processing of your personal data, you can always contact EPCO at the e-mail address indicated in the first paragraph of this clause. If you are still not satisfied with EPCO's response, you are free to lodge a complaint with the competent data protection authority, namely the Data Protection Authority (https://www.dataprotectionauthority.be/).
